Welcome to 3D 4D Ultrasound Flatirons Prenatal Imaging, LLC. By booking an appointment, purchasing products, or visiting our studio, you acknowledge and agree to the following:

1. Non-Medical Nature of Services

• All ultrasounds are elective, non-diagnostic, keepsake sessions.

• We do not provide medical evaluation, diagnosis, or treatment.

• All clients must already be under the care of a licensed physician and have completed a diagnostic ultrasound with their OBGYN.

2. Age & Consent

• Clients must be 18 years or older to book or sign for services.

• If under 18, a parent or legal guardian must provide written consent.

• Emancipated minors may book if they provide court-approved emancipation documents prior to the session.

3. Liability Waiver

• You acknowledge that our staff are not licensed medical professionals.

• We make no guarantee as to the health, condition, or outcomes of pregnancy.

• By using our services, you release and hold harmless 3D 4D Ultrasound Flatirons Prenatal Imaging, LLC, its owners, employees, and affiliates from all claims, including medical negligence, malpractice, or birth outcomes.

4. Gender Determination & Image Quality

• Gender determination is not 100% guaranteed.

• If fetal position or placental placement prevents imaging, one complimentary rescan may be offered within 14 days (if within gestational window).

• Additional rescans may be scheduled at a discounted rate.

• Refunds are not provided, as services are delivered regardless of image quality.

5. Media & Intellectual Property

• We retain ownership of all ultrasound images and videos.

• With client consent, anonymized images may be used for marketing or social media.

• Clients may request in writing prior to their session that images not be used.

6. Digital Files & Cloud Access

• Files are provided digitally (cloud, USB).

• Cloud links expire as specified in the package purchased.

• We are not responsible for lost, deleted, or corrupted files once delivered.

7. Promotions, Offers & Products

• Discounts apply only to the current pregnancy.

• Free items or partner products are provided “as is” and subject to availability.

• We are not liable for partner product quality, claims, or outcomes.

By booking, attending, or purchasing services, you confirm that you have read and accept these terms.

We respect your privacy and comply with the Colorado Privacy Act (CPA). This policy explains what information we collect and how it is used.

1. Information We Collect

• Personal data: name, phone number, email, due date, etc.

• Payment data: securely processed via third-party providers.

• Session content: ultrasound images, videos, and recordings.

We do not collect or store HIPAA-protected medical information. We are not a medical provider, and no diagnostic health data is gathered.

2. How We Use Information

• To confirm bookings, deliver files, and communicate session details.

• To provide customer service and respond to inquiries.

• To send optional promotions or updates (you may opt out at any time).

3. Sharing of Information

• We do not sell or rent your information.

• We only share limited data with service providers (e.g., file hosting, payment processors) necessary to fulfill your service.

• Data may be disclosed if required by law.

4. Data Security

• Data is protected using secure servers, passwords, and encryption where possible.

• Only authorized staff may access personal information.

• Clients are responsible for securing digital files after delivery.

5. Your Rights

Under the Colorado Privacy Act, you have the right to:

• Access, correct, or delete personal data we hold about you.

• Opt out of promotional communications.

• Request a copy of your data by contacting us at wecare@flatironshdultrasound.com.

6. Minors

• We do not knowingly collect information from minors without parental/guardian consent.

• If you believe we have collected data from a minor without consent, contact us and we will promptly delete it.

7. Updates

This policy may be updated periodically. New versions will be posted on this page with a revised effective date.
